Orlando Dependency Attorney
In some Orlando divorce cases where domestic violence, drug abuse or other aggravating circumstances are present, a dependency case may also be combined with the dissolution of marriage and child custody issues. In Florida, when there are allegations that a child has been abused, abandoned or neglected, that child enters the dependency system, meaning the child is alleged to be dependent upon the state for protection. The allegations of abuse, abandonment or neglect are investigated by the Florida Department of Children and Families (DCF) and, if necessary, the children can be removed from the home is it is not safe for them to remain there.
If there is verifiable abuse, abandonment or neglect in the home, DCF can proceed against one or both parents and file a petition for dependency, which essentially alleges the children are dependent upon the state for protection. A case plan will be developed, which may include one or both parents attending parenting, anger management, drug abuse, and other classes and meeting other requirements that may be included in the case plan. The ultimate goal of a dependency action is to make the home a safe one for the children and hopefully reunify the children with the parents.
